Understanding Fireworks Laws in Ohio

As we gear up for Fourth of July celebrations, it's critical to know when, where, and how you can legally set off fireworks in Ohio—and what safety measures to follow.

What’s legal under Ohio law?

Thanks to Amended Substitute House Bill 172, which took effect July 1, 2022, Ohioans may now discharge 1.4G consumer fireworks (commonly known as firecrackers, roman candles, fountains, etc.) on specified holidays and within specific hours—on private property only, and only with the property owner's permission.

Legally permitted display dates include:

• July 3, 4, and 5, plus the Fridays–Sundays before and after

• Labor Day weekend

• Diwali

• New Year’s Eve and New Year’s Day

• Chinese New Year

• Cinco de Mayo

• Memorial Day weekend

Ohio Governor Mike DeWine’s role

Governor DeWine signed House Bill 172 on November 8, 2021, authorizing consumer fireworks on holidays like New Year’s, Cinco de Mayo, Juneteenth, Memorial Day, Fourth of July, Chinese New Year, Diwali, and Labor Day weekends wlwt.com+9whio.com+9ohiosenate.gov+9. Currently, there’s no new action from Gov. DeWine regarding expanding or restricting approved holidays. The approved list above remains in effect heading into 2025.

What Can Local Jurisdictions Do?

🚨 Scam Alert: Fraudsters Posing as Ohio BMV Targeting Local Residents

The Ohio Bureau of Motor Vehicles (BMV) has issued an urgent warning after receiving multiple reports of fraudulent text messages sent to unsuspecting residents.

These messages claim to come from the BMV and falsely state that the recipient has an outstanding traffic ticket. The texts demand immediate payment to avoid a license suspension and may include links designed to steal your personal or financial information.

“Do not fall for this scam,” warns BMV Registrar Charlie Norman. “Do not click any links and delete the text. Ohio BMV will never send you a text demanding payment or requesting your personal information.”

This scam is not isolated to Ohio—it's part of a nationwide phishing scheme. Unfortunately, the messages are convincing enough to trick even the most cautious individuals.

Understanding Ohio’s REAL ID Requirements: A Legal Perspective from Lipson O'Shea Legal Group​

As of May 7, 2025, Ohio residents will need a REAL ID-compliant driver's license or another acceptable form of identification, such as a passport, to board domestic flights and access certain federal facilities.

This change stems from the federal REAL ID Act, enacted in 2005 to enhance security standards for state-issued identification following the events of September 11, 2001. ​ source

What Is a REAL ID?

A REAL ID is a state-issued driver's license or identification card that meets federal security standards. In Ohio, a REAL ID-compliant license features a star in the upper right-hand corner. Standard licenses, which are not compliant, will state "Not for Federal Identification" in the same location. ​source

Why Is the REAL ID Important?

Starting May 7, 2025, the Transportation Security Administration (TSA) will require travelers to present a REAL ID-compliant license or another acceptable form of identification to pass through airport security for domestic flights.Additionally, a REAL ID will be necessary to access certain federal facilities, including military bases and nuclear power plants.​ source

Obtaining a REAL ID in Ohio

Celebrate St. Patty's Day Safely ☘️

Known for being one of the biggest parades in the country, Cleveland knows how to have fun celebrating the day of the Irish.

Ohio’s oldest parade, Cleveland’s St. Patrick’s Day Parade typically hosts over 300,000 attendants. Many are already planning to join this year’s festivities on Sunday, March 17. The parade boasts over 10,000 people participating in the parade route.

With all this celebrating comes increased police presence and DUI arrests. The National Highway Traffic Safety Administration found that 276 people died due to drunk-driving crashes on St. Patrick’s Day from 2009-2013.

Festivities in Downtown Cleveland and beyond are sure to bring good cheer to all, but be aware of reckless drivers and take care to avoid any drunk driving situations.

• Uber: A great way to arrange a car ride to the parade.

• RTA: This is the Greater Cleveland Regional Transit Authority’s busiest day of the year, so the RTA makes many accommodations for this day and offers an easy way to plan your route.

Drive Safe this Deer Season

The Ohio State Highway Patrol reported this is the busiest season for deer on the road and urges extra cautious driving.

“As we enter the peak season for car-deer collisions in Ohio, I encourage drivers to use extra caution and slow down, especially at dawn or dusk when deer are more active,” said Governor DeWine. “A crash with a deer can be just as destructive as a crash with another vehicle, so it’s important that drivers remember to stay alert and watch out for animals crossing the road.”

Distracted driving has no place any time on the road, but especially when deer are known to be running into major highways.

The Ohio State Highway Patrol reported, “27 crashes resulted in fatal injuries to motorists, with 28 killed. Additionally, nearly half (47%) of these crashes occurred in October, November, and December.”

“Always avoid distractions and keep your full focus on the roadway,” said Colonel Richard Fambro of the Ohio State Highway Patrol. “If you see a deer slow down, but do not swerve. If you strike a deer, move to a safe place if you are able, turn on your hazard lights, and report the crash.”

Often Forgotten Traffic Law Leads to Fatality

Ohio’s ‘move over, slow down’ law was ignored and led to one death and four injuries.

As reported by 13 Action News, a recent tragedy could have been avoided had a passing truck slowed down and switched lanes as the law states when an emergency vehicle is pulled over by the side of the road.

“Ohio does have a law ‘move over, slow down’ for any emergency vehicles on the shoulder whether it’s police, fire ambulance, tow trucks, road crew, whoever,” Ohio State Highway Patrol Lieutenant Rustun Schack said. “If someone is on the shoulder you are required to move over and change lanes while passing those people on the shoulder.”

Highway Patrol Cracks Down on Seat Belt Use

In an effort to ensure safety, Ohio along with six other states are ticketing for not being properly restrained.

“Ohio’s safety belt law is still a secondary violation, but troopers say there is zero-tolerance when drivers are stopped for other violations and are found to not be wearing their safety belt,” as reported by WLWT5 News.

With this new measure, traffic stops will also include officers making sure passengers and drivers are all wearing their seat belts.

Make Sure Your Bus Riders Stay Safe

Governor Mike DeWine and Ohio State troopers recently joined forces to enforce “Red Lights Mean STOP” an initiative to ensure all drivers follow required stops behind buses.

According to the Ohio State Highway Patrol, “From 2017 to 2019, there were 3,967 crashes involving school buses reported in Ohio. During that time, five people were killed in five crashes and troopers cited 1,999 drivers who passed a school bus when they were required to stop.”

With so many new students now going back to school, it is even more important for drivers to remember they are required to stop 10 feet from the bus to ensure the children safely enter and exit the bus.

“Ohio drivers need to watch for school buses — especially when they stop to drop off or pick up our students,” Ohio Gov. Mike DeWine said. “Working together, we can ensure that school buses remain the safest mode of transportation for students to and from school,” reported by NBC4.com.

Can You Get Arrested for Not Wearing a Mask?

New Ohio legislation would make it mandatory to wear a face covering in public places.

As reported by News 5 Cleveland, “Cuyahoga County Executive Armond Budish introduced legislation that would require face coverings in public spaces to limit the spread of COVID-19. The proposed ordinance states that any person found without a face mask would be subject to a written warning on the first violation and a civil penalty of $50 for a second and each subsequent violation.”

As with any new legislation, many discussions will arise as to the legality of requiring someone to wear a mask, and already some have criticized the vagueness of Cleveland’s recent face mask order.
