Pre-marital Property Preserved for Client

We finally resolved a long contested divorce case where the wife (not out client) significantly overreached on what she thought she should get in a short 2-year marriage.  

Our client was able to keep all of his pre-marital property – regardless of the feckless arguments made by his estranged wife (and now ex-wife).  

Lots of assets in play in this one, and identifying them and presenting them to the trial court was not an easy task.

DUI Charge Dismissed

We recently resolved a DUI case in another county by having the DUI charge dismissed completely and having the client plea to just the speeding and open container charge.   

It helps very much if your lawyer knows how street DUI investigations are suppose to be done. 

Client was very polite to the police – which also helped very much (police officers really appreciate that). 

Burglary Charge Reduced to Trespass

We recently resolved a questionable Burglary charge in Cuyahoga County by having the client plea to a misdemeanor charge of trespass.  

Significant reduction from the original charge.

Prison Time Avoided

We just resolved a federal probation violation matter, and avoided our client going back to prison (he has to do 40 hours of community service instead). 

That certainly beat him doing 9 months in federal prison.

Criminal Case Resolved

We just resolved a criminal case in a Cleveland suburb which involved a commercial client that was charged with the actions responding to a court official who had entered our client’s premises in a menacing fashion.  

We convinced the city prosecutor to let our client plea to a minor misdemeanor, and the client was able to just pau and fine with no further action. 

Good result for all concerned.

Defamation Case Goes to Trial

We are expected to go to trial this month in a years-long case involving what is called “defamation.”  

The now former mayor of a Cleveland suburb (in order to promote her failed attempt at re-election) deliberately defamed two prior officers in an attempt to cover up her own public dishonesty. 

These cases are heavy with emotion, and we often have to remember what a deliberately defamatory statement can do to a person’s professional reputation.

The True Cost of Insurance: How a Dog Attack Case Reveals Priorities

We have to file suit in a case involving a dog attack of a customer of a business.

We did not want to file suit, and the business owner and our client at one point prior to the attack were friends.

However, the insurance company for the business has been ridiculous in their evaluation of the claim, and therefore our clients reluctantly have to file suit.

This is just another example of where an insurance company cares more about its money than it does its own insured. Very unfortunate.

We are involved with a very serious automobile crash that is a result of an improper police chase from a suburb into the city of Cleveland.

Gathering the public records and videos and body cam and dash cam materials associated with our analysis of this chase case has been somewhat difficult.

Celebrate St. Patty's Day Safely ☘️

Known for being one of the biggest parades in the country, Cleveland knows how to have fun celebrating the day of the Irish.

Ohio’s oldest parade, Cleveland’s St. Patrick’s Day Parade typically hosts over 300,000 attendants. Many are already planning to join this year’s festivities on Sunday, March 17. The parade boasts over 10,000 people participating in the parade route.

With all this celebrating comes increased police presence and DUI arrests. The National Highway Traffic Safety Administration found that 276 people died due to drunk-driving crashes on St. Patrick’s Day from 2009-2013.

Festivities in Downtown Cleveland and beyond are sure to bring good cheer to all, but be aware of reckless drivers and take care to avoid any drunk driving situations.

• RTA: This is the Greater Cleveland Regional Transit Authority’s busiest day of the year, so the RTA makes many accommodations for this day and offers an easy way to plan your route.

Neglect of Protocol Affects DUI Case

We recently succeeded in getting a municipal court to grant what is called a “motion to suppress” in a DUI case.

The Court concluded that the officer involved did not follow the proper protocol in pulling the defendant over and conducting what are called “field sobriety tests.”

Much of this analysis is very technical, and our ability to locate the mistakes (based on our vast experience with those issues) helped very much in the ruling.

Client was very remorseful, and pleased with the outcome.

Underage Party Provides Learning Moment

We recently obtained a mild outcome for a parent-client who was initially charged with permitting an underage party at their home.

We were able to convince the prosecutor that this was an inadvertent mistake by the parents, and more of a product of false viral internet invitation for the minors to come to the home.

Good learning experience for all concerned, parents, child, and the police.

Divided Divorce Assets Complicated by Laws

We are dealing with a number of divorce cases where getting the pension assets divided according to Ohio law is complicated and long.

Ohio law had to intersect with federal law on how pensions are divided in a divorce. We have to work with outside experts in drafting separate pension orders (called “QDROS” in private pensions and “DOPOs” in public pensions), and the whole process can often take a number of months.

We see clients get frustrated with the technical aspects of these orders, and how long the final approval takes. But to make a mistake on these pension orders could have a huge impact on the future of the parties.

Bad Faith Claim Results in Win

We just helped our client resolve an insurance coverage suit where the client’s homeowner’s carrier refused to properly pay for a loss stemming from a broken pipe.

We had to sue the insurance company for what is known as a “bad faith” claim, which is where an insurance company engages in what we call a “bad faith” assessment of the claim.

We were able to get the insurance carrier to pay 3 times what was offered prior to the suit. Client was very happy.

The Data Speaks: Ohio State Highway Patrol Stats from 2023

Ohio State Highway Patrol released its 2023 annual report related to traffic stops. Below are findings that may be of interest.

The analysis of traffic stop data reveals that drivers pulled over by troopers, especially during late-night hours, often receive warnings rather than citations.

Out of 493,000 traffic stops conducted across Ohio from January to October 2023, 41.4% resulted in warnings.

Notably, during the time frame of 10 p.m. to 3:59 a.m., more than 60% of drivers received warnings, indicating a higher likelihood of leniency during these late-night hours.

Interestingly, this leniency contrasts with the fact that late-night hours also see a significant number of citations for suspected drunken driving. In the 1 a.m. hour alone, out of 13,047 drivers stopped, 13.6% were ticketed for suspected drunken driving.

On average, between 11 p.m. and 3:59 a.m., 8.7% of drivers pulled over received drunken driving tickets. This data highlights the nuanced patterns in law enforcement behavior during specific hours on Ohio's roads.
