Pre-marital Property Preserved for Client

We finally resolved a long contested divorce case where the wife (not out client) significantly overreached on what she thought she should get in a short 2-year marriage.

We finally resolved a long contested divorce case where the wife (not out client) significantly overreached on what she thought she should get in a short 2-year marriage.

Our client was able to keep all of his pre-marital property – regardless of the feckless arguments made by his estranged wife (and now ex-wife).

Lots of assets in play in this one, and identifying them and presenting them to the trial court was not an easy task.

It helps very much if your lawyer knows how street DUI investigations are suppose to be done.

Client was very polite to the police – which also helped very much (police officers really appreciate that).

We just resolved a criminal case in a Cleveland suburb which involved a commercial client that was charged with the actions responding to a court official who had entered our client’s premises in a menacing fashion.

We convinced the city prosecutor to let our client plea to a minor misdemeanor, and the client was able to just pau and fine with no further action.

Good result for all concerned.

The Spring Surge: Why DUI Poses Greater Risks for Motorcyclists

While it's a thrilling time for riders to dust off their bikes and hit the open road, it also poses significant risks, especially when combined with the dangers of driving under the influence (DUI).

As the temperatures rise and the flowers bloom, springtime brings about a surge of motorcycles on the roads.

While it's a thrilling time for riders to dust off their bikes and hit the open road, it also poses significant risks, especially when combined with the dangers of driving under the influence (DUI).

At Lipson O'Shea Legal Group, we're passionate about keeping our roads safe, and we're here to shed light on the heightened dangers that springtime DUI presents to motorcyclists.

Motorcyclists are already more vulnerable on the road due to their lack of protective barriers. When impaired drivers enter the equation, the risks skyrocket. Alcohol impairs judgment, coordination, and reaction time – all crucial skills for safe motorcycle operation. Even a slight lapse in concentration can lead to devastating consequences for motorcyclists.

During the spring, as more bikers take to the streets to enjoy the weather and scenic rides, the probability of encountering impaired drivers also increases. Whether it's due to holiday celebrations, outdoor events, or simply more traffic on the roads, the dangers are palpable.

At Lipson O'Shea Legal Group, we understand the unique legal challenges faced by motorcyclists involved in DUI incidents. Our experienced team is dedicated to providing robust legal defense and fighting for the rights of motorcyclists who find themselves in these unfortunate situations.

As advocates for road safety, we urge all motorists to refrain from drinking and driving, especially during the spring months when motorcycles are out in full force. Let's work together to make our roads safer for everyone.

The True Cost of Insurance: How a Dog Attack Case Reveals Priorities

This case is an unfortunate example of where an insurance company cares more about its money than it does its own insured.

We have to file suit in a case involving a dog attack of a customer of a business.

We did not want to file suit, and the business owner and our client at one point prior to the attack were friends.

However, the insurance company for the business has been ridiculous in their evaluation of the claim, and therefore our clients reluctantly have to file suit.

This is just another example of where an insurance company cares more about its money than it does its own insured. Very unfortunate.

Case Brings Attention to Auto Insurance Policy

this particular case is another reminder of how important it is for folks to check their own insurance policies to make sure they have enough of what we call “underinsured” and “uninsured” coverage.

We are involved with a very serious automobile crash that is a result of an improper police chase from a suburb into the city of Cleveland.

Gathering the public records and videos and body cam and dash cam materials associated with our analysis of this chase case has been somewhat difficult.

We see more and more of these cases currently. However, this particular case is another reminder of how important it is for folks to check their own insurance policies to make sure they have enough of what we call “underinsured” and “uninsured” coverage to protect them from people who are engaged in criminal activities or who are probably uninsured at the time of the automobile accident.

Take a look at your policy today. Make sure that you have coverage the exceeds $500,000 or more. This increased coverage does not cost a lot. Something to consider

March is Brain Injury Awareness Month 🧠

Despite advancements in workplace safety regulations and protocols, accidents resulting in brain injuries remain a real and significant threat to workers across various industries.

As we recognize March as Brain Injury Awareness Month, it's crucial to highlight the ongoing risks that workplace injuries pose to employees.

Despite advancements in workplace safety regulations and protocols, accidents resulting in brain injuries remain a real and significant threat to workers across various industries.

From construction sites to office environments, employees face potential hazards that could lead to traumatic brain injuries (TBIs) if proper precautions are not taken. Falls, being struck by objects, vehicle accidents, and exposure to hazardous materials are just a few examples of situations where TBIs can occur in the workplace.

Employers have a legal obligation to provide a safe working environment for their employees, including implementing measures to prevent accidents and injuries. This includes conducting regular safety assessments, providing appropriate training, and ensuring that safety protocols are followed at all times.

In the unfortunate event of a workplace injury resulting in a brain injury, employees have rights under workers' compensation laws to receive medical treatment, rehabilitation, and financial compensation for their injuries. Seeking legal counsel from experienced attorneys who specialize in workplace injury cases is essential to ensure that injured workers receive the compensation they rightfully deserve.

As we strive to raise awareness about brain injuries this month, let us also reaffirm our commitment to promoting workplace safety and protecting the well-being of all employees. Together, we can work towards preventing workplace accidents and reducing the incidence of brain injuries in the workplace.

Celebrate St. Patty's Day Safely ☘️

Ohio’s oldest parade, Cleveland’s St. Patrick’s Day Parade typically hosts over 300,000 attendants. Many are already planning to join this year’s festivities on Sunday, March 17.

Known for being one of the biggest parades in the country, Cleveland knows how to have fun celebrating the day of the Irish.

Ohio’s oldest parade, Cleveland’s St. Patrick’s Day Parade typically hosts over 300,000 attendants. Many are already planning to join this year’s festivities on Sunday, March 17. The parade boasts over 10,000 people participating in the parade route.

With all this celebrating comes increased police presence and DUI arrests. The National Highway Traffic Safety Administration found that 276 people died due to drunk-driving crashes on St. Patrick’s Day from 2009-2013.

Festivities in Downtown Cleveland and beyond are sure to bring good cheer to all, but be aware of reckless drivers and take care to avoid any drunk driving situations.

  • Uber: A great way to arrange a car ride to the parade.

  • RTA: This is the Greater Cleveland Regional Transit Authority’s busiest day of the year, so the RTA makes many accommodations for this day and offers an easy way to plan your route.

Drivers are encouraged to call #677 if you suspect impaired driving, and the offices of Lipson O'Shea are available 24/7 if you have found yourself charged with a DUI.

We recently succeeded in getting a municipal court to grant what is called a “motion to suppress” in a DUI case.

The Court concluded that the officer involved did not follow the proper protocol in pulling the defendant over and conducting what are called “field sobriety tests.”

Much of this analysis is very technical, and our ability to locate the mistakes (based on our vast experience with those issues) helped very much in the ruling.

Client was very remorseful, and pleased with the outcome.

Divided Divorce Assets Complicated by Laws

We are dealing with a number of divorce cases where getting the pension assets divided according to Ohio law is complicated and long.

Ohio law had to intersect with federal law on how pensions are divided in a divorce. We have to work with outside experts in drafting separate pension orders (called “QDROS” in private pensions and “DOPOs” in public pensions), and the whole process can often take a number of months.

We see clients get frustrated with the technical aspects of these orders, and how long the final approval takes. But to make a mistake on these pension orders could have a huge impact on the future of the parties.

We just helped our client resolve an insurance coverage suit where the client’s homeowner’s carrier refused to properly pay for a loss stemming from a broken pipe.

We had to sue the insurance company for what is known as a “bad faith” claim, which is where an insurance company engages in what we call a “bad faith” assessment of the claim.

We were able to get the insurance carrier to pay 3 times what was offered prior to the suit. Client was very happy.

Revolutionizing Justice: The Impact of Artificial Intelligence on the Legal Industry

In the fast-paced world of law, where time is often of the essence, Artificial Intelligence (AI) is proving to be a game-changer, revolutionizing the traditional practices of the legal industry.

In the fast-paced world of law, where time is often of the essence, Artificial Intelligence (AI) is proving to be a game-changer, revolutionizing the traditional practices of the legal industry.

From legal research to contract management and beyond, AI is transforming the way legal professionals operate, offering unprecedented efficiency and accuracy.

One of the most notable changes is evident in legal research. AI-powered tools equipped with Natural Language Processing (NLP) capabilities can swiftly analyze vast databases of legal documents, statutes, and case law. This not only expedites the research process but also enhances the precision of results, allowing lawyers to access relevant information at their fingertips.

Document review and due diligence, once labor-intensive tasks, have also undergone a remarkable transformation. AI systems, armed with machine learning algorithms, can sift through mountains of documents with unparalleled speed. Predictive coding enables these systems to identify and prioritize documents for review, significantly reducing the time and resources required for due diligence processes.

Contract management has experienced a paradigm shift with the integration of AI. Automation tools streamline the creation, review, and management of contracts, ensuring accuracy and compliance. Virtual legal assistants powered by AI are handling routine tasks, freeing up human lawyers to focus on more complex aspects of their work.

Moreover, AI's predictive modeling capabilities are assisting legal professionals in anticipating case outcomes, providing valuable insights into judge behaviors and legal trends. This data-driven approach empowers lawyers to make more informed decisions and develop strategic legal solutions.

While AI is undeniably enhancing efficiency in the legal domain, it is crucial to address ethical considerations, such as bias in algorithms, to maintain the integrity of the legal profession.

Lipson O’Shea will continue to report on the profound impact of AI on the legal landscape. It is evident that the synergy between technology and law is shaping a future where justice is not just blind but also incredibly smart.

The Data Speaks: Ohio State Highway Patrol Stats from 2023

Ohio State Highway Patrol released its 2023 annual report related to traffic stops. Here are some findings that may be of interest.

Ohio State Highway Patrol released its 2023 annual report related to traffic stops. Below are findings that may be of interest.

The analysis of traffic stop data reveals that drivers pulled over by troopers, especially during late-night hours, often receive warnings rather than citations.

Out of 493,000 traffic stops conducted across Ohio from January to October 2023, 41.4% resulted in warnings.

Notably, during the time frame of 10 p.m. to 3:59 a.m., more than 60% of drivers received warnings, indicating a higher likelihood of leniency during these late-night hours.

Interestingly, this leniency contrasts with the fact that late-night hours also see a significant number of citations for suspected drunken driving. In the 1 a.m. hour alone, out of 13,047 drivers stopped, 13.6% were ticketed for suspected drunken driving.

On average, between 11 p.m. and 3:59 a.m., 8.7% of drivers pulled over received drunken driving tickets. This data highlights the nuanced patterns in law enforcement behavior during specific hours on Ohio's roads.
