Major Auto Accident Litigation
We just resolved a long and complicated litigation involving a horrible van/truck/automobile accident that happened on I-90.
We just resolved a long and complicated litigation involving a horrible van/truck/automobile accident that happened on I-90.
Two people died in 2 separate accidents that happened in the same area, and a third person was severely injured.
The city that I represented also lost a very expensive piece of fire equipment. There was limited insurance available to the injured parties, so there was two years worth of litigation to sort out who should get what.
After some serious mediation by a very good mediator, we were able to work it all out.
Federal Case Concluded
We just ended a two-year long federal criminal case that involved thousands of exhibits and many complicated computer technology and fraud issues.
We just ended a two-year long federal criminal case that involved thousands of exhibits and many complicated computer technology and fraud issues.
We were in trial for almost three weeks on the case. Our client was extradited from Romania to face federal prosecution and trial here in Ohio.
This was one of those cases where we had hoped the client would take the deal that the Government had offered.
Complex Insurance Lawsuit
We just resolved a bad faith insurance lawsuit that our injured client had to file against his own insurance company.
We just resolved a bad faith insurance lawsuit that our injured client had to file against his own insurance company.
The insurance company did not properly handle his “underinsured” claim (the person who hit him had very limited insurance coverage).
We can’t stress enough how important it is to have sufficient “uninsured” and “underinsurance” coverage on your personal automobile policies.

Michael O'Shea Leads DUI Presentation
Attorney Michael O’Shea presented a course to fellow municipal prosecutors on the complications and tactics in prosecuting DUI cases where the defendant has refused a breathalyzer test.
Attorney Michael O’Shea presented a course to fellow municipal prosecutors on the complications and tactics in prosecuting DUI cases where the defendant has refused a breathalyzer test.
These are not easy cases to prosecute, and there are methods and tactics that Mr. O’Shea has learned from a decade of prosecuting these types of cases in his hometown (where he is the local prosecutor).
It was an informative and useful course to all prosecutors in attendance.
Complex Divorce Case Settled
Recently we were able to resolve a long and contested divorce case which involved huge debt and real estate in Cleveland, the Bahamas and in Florida.
Recently we were able to resolve a long and contested divorce case which involved huge debt and real estate in Cleveland, the Bahamas and in Florida.
In addition we also had to fight with a corporation in Pennsylvania that refused to cooperate with the Court and sought to get themselves (without success) dismissed from the case and to get out of various restraining orders.
It was a very complicated and long process and we had to put up quite a fight for our client, but eventually succeeded in getting her the deal she wanted.
Successful DUI Outcome
We were able to get a reduced plea in a complicated DUI case in a mid-Ohio county.
We were able to get a reduced plea in a complicated DUI case in a mid-Ohio county.
Our client had previous DUI convictions. We had a sufficient amount of difficulty getting the local prosecutor and judge to agree to treat our client as if it were his first DUI, but we did it.
This was a very delicate situation but we secured the best possible outcome for our client.
Personal Injury Against Grill Manufacturers
We just resolved an interesting claim involving an outside grill that exploded in our client’s back yard.
We just resolved an interesting claim involving an outside grill that exploded in our client’s back yard.
Client was not injured too badly, but we were able to resolve the claim against the grill company.
Client never believed they would pay but we worked tirelessly on his behalf.
Divorce and Custody Case Resolved
We just resolved a very long and complicated divorce case involving people living in other states and other houses – with two young, bright kids.
We just resolved a very long and complicated divorce case involving people living in other states and other houses – with two young, bright kids.
It took about a week of trial, and many witnesses to get the parties where they needed to be in order to resolve the case.
But it did resolve and our client was pleased with the outcome.
Federal Drug Sentencing Case
We are working on an interesting federal sentencing matter.
We are working on an interesting federal sentencing matter.
Our client (who has an extremely long criminal history) was convicted by a federal jury in January.
He has of a history of drug dealing charges. It is very sad, because this young man has the potential of being sentenced to 30 or more years in federal prison.
Stay tuned for details.
DUI Arrest in Metroparks
Just this week we were able to resolve a slightly serious DUI that happened in one of the area Metroparks.
Just this week we were able to resolve a slightly serious DUI that happened in one of the area Metroparks.
Although the blood alcohol in the client was very high, we were able to place the many personal family issues in front of the judge in such a way as to get the judge to only order the bare minimum sentence for the client.
This single working mother was (all things considered) very grateful about the outcome.
Ohio Worker's Compensation and Insurance Battle
We are currently working for a husband and father who suffered a difficult work injury which has had him incur a six figure worker’s compensation claim.
We are currently working for a husband and father who suffered a difficult work injury which has had him incur a six figure worker’s compensation claim.
Now, his own insurance company has insulted he and his family by offering him compensation that nets out to be almost nothing.
This is because whatever he gets from his own insurance company will be claimed by the Ohio Worker’s Compensation as “reimbursement” for the claim they created for his injury.
In fact, the Ohio Worker’s Compensation system has essentially sued our client to try and get all of this insurance money. The fight for ethical compensation for our clients’ injuries almost never ends.
Major Victory for Father
We just got done last week with getting a young father sole exclusive custody of his toddler son.
We just got done last week with getting a young father sole exclusive custody of his toddler son.
Even in 2019, there appears to be a bias against males and parenting with their children.
This was not an easy case and we are happy for this young man who is a great parent.
Jail Time Avoided for Serious DUI Charges
We just had a rather serious case for a client that worked out the best way it could.
We just had a rather serious case for a client that worked out the best way it could.
After leaving a local tavern, the client was followed by a police officer – and when the officer attempted to pull over the client, the client (in a very impulsive manner which upon reflection the client seriously regrets), fled in his car for a short while and then (successfully) on foot.
The police did not have much difficulty figuring out who he was (video is everywhere).
The client was facing about a year in jail for all of this.
However, we worked hard to professionally negotiate a resolution which required that the client pay a big fine and do only (and we mean only) a weekend in jail.
DUI Reduction for Young Client
We were happy this week to get a well deserved reduction for a young man (just starting out in his professional career) who had been arrested for a DUI in March.
We were happy this week to get a well deserved reduction for a young man (just starting out in his professional career) who had been arrested for a DUI in March.
As we have stated before, although there are a number of opinions about what you should do and say when pulled over by the police for a suspected DUI case, it is always best to be polite.
It also helps when you are polite during the legal process. In this case, in addition to the legal issues we were able to identify through a review of the dash cam video, the overall polite and cooperative tone of the arrest and court process aided in convincing the prosecutor and police that the young man was entitled to a reduction.
Good young man who made a mistake. Now he can get on with his life with a great lesson.
Computer Crime Federal Jury Trial Ends
We just finished a two and a half week long federal jury trial involving computer crime.
We just finished a two and a half week long federal jury trial involving computer crime.
This case was extremely technical and voluminous. Over 2,000 exhibits and witnesses from all over the United States and the world were called in.
The charges Involved a 10-year long FBI investigation of computer fraud and an allegation that citizens from Romania were involved in internet fraud of US citizens.
Lawsuit On Behalf of New Homeowner
We are representing a homeowner who purchased a home located near a ravine.
We are representing a homeowner who purchased a home located near a ravine.
What the home sellers failed to tell our clients is that the foundation near the ravine was moving and that parts of the back porch had to be aligned because of this.
Now the entire back porch of the house has recently collapsed – and almost took part of the back of the house with it.
These types of lawsuits get emotional for home buyers/owners – who just want to relax in their home after a long day at work. Stay tuned on this one.
Mistreatment in Jail Case
We are representing a young woman who lost sight in her eye due to the mistreatment by the jail guards and nurses at the Cuyahoga County Jail.
We are representing a young woman who lost sight in her eye due to the mistreatment by the jail guards and nurses at the Cuyahoga County Jail.
The lawsuit was recently featured on Fox 8.
Our client fell in a large pool of water, which was coming from a cell from sink/toilet which had been leaking for many days and running out into the areas which service the inmates of the jail. She told jail officials she hit her head and was, "Seeing colored spots and lines in her left eye."
After waiting three weeks to be seen by a doctor our client was then denied her prescribed eye drops.
Stay tuned for details on this.
Personal Injury Settlement for Elderly Client
We recently settled a long-pending personal injury suit where an elderly woman fell on ice at her senior living apartment complex in Euclid.
We recently settled a long-pending personal injury suit where an elderly woman fell on ice at her senior living apartment complex in Euclid.
The private for-profit complex (which obviously does not like spending money on almost anything even though the complex is for elderly people), refused to fix a leaking water fountain – despite the fact that the leaking water froze on the ground causing a serious hazard for the residents.
Our client suffered a terrible injury and we were proud to gain a settlement for her.
No Dismissal For Legal Malpractice Claim
We are pleased to announce that we obtained a very good decision from an Ohio Court of Appeals which reversed a trial court’s dismissal of a legal malpractice claim against a local divorce attorney.
We are pleased to announce that we obtained a very good decision from an Ohio Court of Appeals which reversed a trial court’s dismissal of a legal malpractice claim against a local divorce attorney.
Our client had been represented by a low cost divorce attorney who believed (because of the low cost) that she (the attorney) had no obligation to (A) investigate any of the assets of the parties and (B) analyze the tentative agreement the client had made with her soon-to-be-X.
Our expert severely frowned on this, but the trial court still dismissed the case on a technical argument that alleged that our client just made a bad deal.
The Court of Appeals (ruling 3-0 in our favor) said absolutely not.
Defamation Lawsuit Dismissed In Favor of Our Client
We were successful in getting a major portion of a frivolous defamation lawsuit dismissed that was brought against our client.
We were successful in getting a major portion of a frivolous defamation lawsuit dismissed that was brought against our client.
The plaintiff had a baseless lawsuit, but it was funded by a wealthy person who actually paid hundreds of thousands of dollars to a young lawyer to continue to pursue what were patently frivolous claims.
